These terms and conditions ("Terms") govern your use of the websites operated by XPLG Ltd. and its subsidiaries, including XPLG Llc. (collectively "XPLG", "we", "us"), at xplg.com, dock.xplg.com, wiki.xplg.com and support.xplg.com (the "Website"). By using the Website you agree to these Terms. If you do not agree, do not use the Website.
1. The Website and the Software
The Website describes The AI Streams Platform and its modules FLUX, PORTX, XPOLOG, LOGX and AUDITY (the "Software"). Downloading, installing or using the Software is governed by the End-User License Agreement ("EULA") and, where personal data is processed, by the Data Processing Agreement. If these Terms conflict with the EULA in relation to the Software, the EULA prevails.
2. Accounts, Trials and Evaluations
Sign-up, sign-in, trial licenses, evaluation workspaces and purchases are handled on XPLG Dock at dock.xplg.com. Trial and evaluation licenses are granted on the terms set out in the EULA (including the free, no-obligation trial usage and the trial period). A subscription or purchase starts only when XPLG, or an authorized XPLG Partner, confirms the order in writing or through Dock.
3. Pricing
Prices shown on the Website are indicative, exclusive of taxes, and may be changed without notice. The price that applies to you is the one stated in your Purchase Order or Dock order confirmation.
4. Acceptable Use
You agree not to: (a) misuse forms, chat or APIs on the Website, including by submitting false, abusive or unlawful content; (b) attempt to gain unauthorized access to the Website, Dock or any related system; (c) interfere with the operation or security of the Website; (d) scrape or harvest personal data from the Website; or (e) present XPLG marks, product names or content as your own.
5. Intellectual Property
The Website, its design, text, graphics, video, logos and software are owned by XPLG or its licensors and are protected by copyright, trademark and other laws. XPLG, XpoLog, PortX, LogX, Flux and Audity are marks of XPLG Ltd. Customer marks appear with permission and belong to their owners. Nothing on the Website grants you a license to any intellectual property except the limited right to view the Website for your own evaluation and business use.
6. Content and Links
Information on the Website is provided for general information about the Software. It is not legal, security or compliance advice and does not form part of any warranty. Warranties, service levels and support commitments are set out in the EULA, the Purchase Order and any applicable service level agreement. The Website may link to third-party sites and services that XPLG does not control; XPLG is not responsible for their content or practices.
7. Privacy
Personal data submitted through the Website (for example through Contact, Download, Sign up or the assistant) is handled in accordance with the Privacy Policy and the GDPR Privacy Policy. The Website stores a single consent preference in your browser and loads analytics or tag management only after you accept.
8. Disclaimer and Limitation of Liability
THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, XPLG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE. Liability in connection with the Software is governed by the EULA.
9. Changes
XPLG may update the Website and these Terms at any time. Changes take effect when posted. Continued use of the Website after a change means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Any dispute arising from the Website is subject to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel.
